Israel, the Arabs, and International Law: Whose Palestine Is it Anyway?

Abstract

In recent years no conflict has engendered as much disagreement as the Arab-Israeli conflict. Both sides have used every means available to them – from the use of force to international law – to bolster their respective claims. In spite of its frequent use as a political tool, international law can, and does, provide a framework for a resolution to the Palestine question. Any analysis includes a consideration of international legal principles, including the Palestine Mandate, and their historical application to the parties. Specifically, the 1967 United Nations Resolution 242 demands the return of territories captured by Israel in 1967 in exchange for secure boundaries peacefully accepted by all parties. At present, international law recognizes that Israel is the legal possessor of the disputed territories; its proper application, however, would suggest that Israel holds these territories in stewardship for the people of the territories, in anticipation of a final settlement. *** Aucun conflit n’a engendré autant de discordance depuis quelques années que le conflit israélo-arabe. Les deux côtés au conflit ont utilisé tous les moyens en leur puissance – de la force au droit international – pour soutenir leur position respective. En dépit de l'utilisation fréquente du droit international comme outil politique, il fournit une charpente pour la résolution de la question de la Palestine. L'analyse englobe les principes du droit international incluant le Mandat Palestinien, et leur application aux parties. Cette étude analyse de façon particulière la Résolution 242 passée par les Nations Unies en 1967 qui revendique que les territoires capturés en 1967 soient rendus en échange pour des frontières pacifiques acceptées par toutes les parties. Présentement, le droit international reconnait Israël comme le possesseur légal des territoires disputés. Mais la bonne application du droit international suggère plutôt qu'Israël tienne en intendance ces territoires pour le peuple de ces territoires en anticipation d'un arrangement définitif.
