Abstract
The Grievor was refused special leave for March 6, to drive his child from Moncton to a hospital appointment in Halifax the next day. He had arranged for his rotating day off on the 7th, but left on the 6th when heavy snow was forecast; 24 cm in fact fell on the 7th. The Post Office representative argued that it was irresponsible to arrange only one morning to drive in a period of winter storms; that it was a gamble only the Employer could lose; and that the Collective Agreement allowed special leave only when employees are "prevented" from reporting for work.
