Abstract

Before the grievance could be heard, the Employer raised a preliminary objection regarding the format of the hearing. The Employer wished to have the grievance heard in accordance with the formal arbitration procedure rather than the regular procedure herein. The collective agreement provides that at the request of a party a grievance of "such an exceptional nature" may be referred to the formal arbitration procedure.
