Abstract
The Grievor, seasonally employed as third cook in the Stewards Department on the Yarmouth-Bar Harbour ferry, lost his job on the spare list because he had failed to report for duty within eight hours of notice to do so. He therefore forfeited his seniority in accordance with the Collective Agreement. The Union's position is that the Company's actions are unjust and inconsistent with the practice followed with respect to the unavailability of spare and relief employees. The Employer argues that it more than met the requirements of the Collective Agreement having made many attempts to recall the Grievor.
