Abstract
The Grievor, a Mail Service Courier, developed a viral infection which affected his balance. He was given a temporary modified duty assignment. After doing the work for nine months, he received a letter advising him to proceed on Certified Sick Leave. It is undisputed that this action was taken without consultation or agreement with the Union. The Employer made the decision because the Grievor was a MSC, not a letter carrier, and there were more letter carriers with a claim for modified duties than the module could accommodate. There were no other modified duties to which the Grievor could be assigned.
