Abstract

The Grievor was denied promotion on grounds that he did not meet the qualifications. At the final grievance step, his personality traits were cited by the Employer, and management right to deny asserted. The Union argued that not all persons holding similar jobs had the qualifications specified in the job description, and produced correspondence and a witness in support of its claim that the Grievor had educational qualifications equivalent to those required by the job.
