Abstract
Union grievance alleging breach of the Collective Agreement between the parties bearing the expiry date 31-07-89 but kept in force by legislation, and in particular of Articles 13.06 and 11.03 in that the Employer created new full-time P.O.4 positions and staffed them by re-assigning members of the UPCE/PSAC bargaining unit without following Article 13.06 or, in the alternative, Article 11.03. In the grievance the Union requested an order that the Employer grant full redress to all those employees adversely affected by this violation and take immediate action to comply with the provisions in the Collective Agreement for the filling of vacancies.
