Abstract
This is a supplementary award. The grievor, an airline pilot, was dismissed for incompetence based on his employment record and the fact that he failed two standard Transport Canada check rides in a flight simulator. The grievor claimed that he was ill at the time of the first test. In the initial award the arbitrator concluded that the grievor was entitled to a second re-ride. Again the grievor failed the check-ride. The grievor objected to the use of a particular person to operate the simulator. The arbitrator had retained jurisdiction to deal with issues arising out of this new check ride.
