Abstract
The Employer created new full-time positions and filled them by re-assigning members of the UPCE/PSAC bargaining unit, contrary to the Collective Agreement. A previous grievance established the right of employees already in the bargaining unit to apply for the new vacancies. This arbitration is to determine an appropriate remedy for for those employees upon whose situation the parties cannot agree, and to clarify certain issues arising from the previous award.
