Abstract
The Union requests that the Employer fill the position of an employee who has been on long term absence of at least two years due to illness. The Employer responded to the grievance, after a hearing, by agreeing to review the employment records and schedules and temporarily fill the long term absence position if it were cost effective. They concluded that filling the full-time position was not justified during much of the year, but agreed to do so during October, November and December, after which a new determination would be made. The Union position is that the Collective Agreement does not allow this sort of filling of long term absence by a term shorter than the remainder of the regular incumbent's absence.
