Abstract
The Grievor was discharged after an investigator, hired by the Employer, obtained a confession of theft during an interview. No union representation was present at this interview. The Union believes the Employer breached the Collective Agreement and thus the confession and any other evidence of theft should be considered inadmissible. The Employer did not believe union representation was needed since this was a third party interview and the case could be proved without the confession.
