Abstract
This is a group grievance, which states that the Employer did not replace a Registered Care Worker (RCW) who was on leave for a one night shift. The Union believed that a RCW should have been scheduled and, in the future, wants the Employer to interpret the Agreement accordingly. It also wants damages to be awarded to the RCW who would have been called in to cover that shift. The Employer believed the Collective Agreement permitted management to organize and reassign duties for valid business reasons. The needs of the residents were below capacity and those already scheduled for the shift were qualified RNs and could cover for the absent RCW. Thus an additional person did not need to be scheduled.
