Abstract

This is a supplementary award. The Grievor had been terminated for inappropriate behaviour towards a female bus passenger. The Award reinstated the Grievor to his position after a one month suspension and two conditions. The Employer asked the Supreme Court of Nova Scotia for a decision on the second condition. The latter ordered the Arbitrator to clarify the condition. There was also a difference of opinion regarding the start date of the "Sunset Clause" dealing with the retention of disciplinary records.
