Abstract

Union grievance on behalf of all long term employees in Group 2 alleging breach of the Collective Agreement between the parties bearing the date July 31, 1992, and in particular of Articles 14, 44 and Appendix A, in that they did not receive rest pay for their rest periods for the 1992 calender year. The Employer refused to pay those benefits on the basis that they did not have the status of "term employee, employed for three (3) months or more" under Article 44.04 of the Collective Agreement. The Union requested that the Employer be ordered to treat the Grievors as having that status and grant them full redress in the way of all lost rights, earnings and benefits.
