Abstract
The Grievor is an experienced fisherman, employed by the Employer as a sharesman, who was off work on workers' compensation because of an injury to his shoulder and arm. He was operated on successfully for carpal tunnel syndrome, but when he sought to return to work, the Employer refused him on the advice of its medical advisor. The Grievor's own doctor and the relevant specialist pronounced him ready to return to his regular duties. The Employer's advisor judged him not fit to sail, having examined his overall fitness to return to scallop fishing.
