Abstract
The grievance relates to the rights and obligations of the Employer and the Grievor in the context of the Grievor's return to work after a long period on disability insurance. The Union alleges that the Employer was unreasonably preventing the Grievor from returning to work for more than two hours per day. The Employer made a preliminary objection to the general introduction of the Union's documents before calling witnesses. They suggest that the Arbitrator should give up jurisdiction in this matter having admitted in evidence a letter which related to a settlement.
