Abstract
The Employer had filled a vacant position with a temp because the position was to be deleted at the end of the year. The Union believes that this is contrary to the Collective Agreement. As remedy the Union wants the Employer to recognize the error in writing, staff the position as the Agreement requires, and grant full redress to all affected employees.
The grievance succeeds. The Collective Agreement clearly requires the vacant position to be filled. The senior applicant on file at the time the position became vacant is to be considered to have been given the position and to be accorded all the rights under the Collective Agreement. Jurisdiction is retained.
